The Kaduna state High Court sitting at Dogarawa in Sabon Gari local government area of Zaria, Kaduna state, has ruled in favour of Ambassador Ahmad Nuhu Bamali.
The court, presided over by Justice Kabir Dabo, has also ordered the installation of Ambassador Ahmad Nuhu Bamalli as the 19th of Zazzau and Chairman Kaduna state Council of Emirs and Chiefs, coming Monday, 9th November 2020.
The presiding judge handed the ruling on Friday, the last adjourned date fixed for ruling on the interlocutory injunction application moved by Alhaji Bashir Aminu (Iyan Zazzau), referred to as Plaintiff, through his counsel, Yunus Ustaz Usman.
Barr. Usman had filled a case before the court against the state government and 10 others referred to as Defendants, challenging the appointment of Ambassador Ahmad Nuhu Bamalli as the 19th Zazzau’s Emir, following the death of late Emir of Zazzau, Alhaji Shehu Idris, who died on 20th September after a brief illness, but the court refused his application for interlocutory injunction.
The court held that the refusal of the Plaintiff’s application was in the interest of peace and security and to avert any possible crises in the emirate.
It held that granting the application could create a vacuum in Zazzau Emirship stool, which would possibly not go down well with subjects of the emirate and could ignite crises and breach of security to the domain.
The court also held that refusal of the injunction was better than granting it, as it could push the subjects of the emirate into crises when the vacuum of the Emirship was created.
However, our correspondent reported that the court adjourned to 18th of November, 2020, when an accelerated hearing on the substantive Suit will commence as it granted the application to that effect.
