KADUNA – The National and State Assemblies Tribunal sitting in Kaduna has on 6th August, 2020, upheld the re-run election declaration of the February, 2020, that Hon. Comfort Amwe of the PDP was the winner for the Kaduna State House of Assembly in Sanga constituency.
The re-run election followed the order by the Court of Appeals, which directed for another to be conducted in the constituency after the 2019 general election.
The Tribunal had in a unanimous judgment delivered yesterday dismissed in its entirety the petition filed by Hon. Haliru of APC challenging the return of Hon. Comfort Amwe as duly elected member of the Kaduna State House of Assembly representing Sanga State constituency.
It would be recalled that, Hon. Haliru and APC approached the Tribunal seeking for the nullification of the election of Hon. Comfort Amwe of the PDP on two grounds, namely, that (1) the election was invalid by reason of non-compliance to the Electoral Act, 2010 (as amended) or corrupt malpractices, (2) that the Respondents did not get the majority of lawful votes cast at the election.
In its well considered judgment, which lasted about 5 hours, the Tribunal rejected the submissions of lead counsel for the Petitioners, I.K. Bawa, SAN, and upheld the submissions of Samuel Atung, Esq., for the 2nd & 3rd Respondents and Halima Gachi, Esq., for the 1st Responders.
In the final analysis, the Tribunal found that the Petition was bereft of any merit and, accordingly, dismissed same. The Tribunal also consequently ordered Hon. Haliru and the APC to pay Hon. Comfort Amwe and the PDP the sum #100,000 each as damages.
Speaking to newsmen shortly after her victory at the Tribunal, Mrs. Amwe thanked God for the victory and praised the Tribunal for its professionalism and “for being the last hope of the common man.”
She also appreciated her teeming supporters that their unalloyed loyalty has always been her strength, noting that, “God will reward everyone for ensuring her victory, both at polls and at the Tribunal.”
